REPORT ILLEGAL CONTENT — DSA Article 16 notice-and-action (Selv-a)

1. What this page is
Luminibus S.r.l.s. socio unico, a single-person company registered in Italy (C.F. / P.IVA 03034600183; REA PV 340161; PEC luminibus@legalmail.it), operates the Selv-a Service as a hosting provider within the meaning of Article 3(g)(iii) of Regulation (EU) 2022/2065 ("Digital Services Act" or "DSA").
This page is the in-repo notice-and-action mechanism required by Article 16 DSA. It lets any natural or legal person submit a notice that specific content accessible on the Service is illegal under EU law or the law of a member state, so that Selv-a can decide whether to act on it.
2. What this page is not
This page is not the channel for general support questions, privacy requests (privacy@selv-a.com), copyright complaints under the Italian implementation of the InfoSoc Directive (which follow the notice-and-action set out in §4 below), or out-of-court dispute resolution under Article 21 DSA. The designated out-of-court dispute settlement body is Conciliaweb AGCOM, as recorded in the Terms §19.
3. How to submit a report
Send the following information to privacy@selv-a.com with the subject line "DSA Article 16 — illegal content notice". A written reply is issued without undue delay per Article 16(4) DSA.
- Your contact details: full name (or registered name for legal persons), email address, and whether you are submitting as (a) an individual, (b) a legal entity, or (c) a trusted flagger within the meaning of Article 22 DSA.
- The precise electronic location of the content: the full URL or in-app navigation path (for example: /chronicle/post/<id>, /postcard/<id>, /shared-compare/<id>).
- An explanation of why you consider the content illegal, with specific references to the EU law or member-state law alleged to be infringed. General references to "illegal" or "offensive" are not sufficient.
- A statement of good faith confirming that the information and allegations are accurate and complete to the best of your knowledge.
4. Statutory notices
- Copyright (Italian implementation of Directive 2001/29/EC and Directive (EU) 2019/790): take-down requests follow the same channel above and are acted on under Law 633/1941 and the AGCOM copyright enforcement regulation. The DSA Article 16 notice does not replace the copyright notice requirements — both are processed on the same channel but under the applicable regime.
- GDPR rights (erasure, rectification, objection): do not use this page. Send a request to privacy@selv-a.com or use Settings → Privacy in the app.
- Child Sexual Abuse Material (CSAM): report directly to law enforcement and to the Italian Safer Internet Centre (www.cleanternet.org / 114 helpline). Selv-a will act on any such content immediately upon notice and will refer the matter to the competent authorities.
5. What happens after a report is submitted
- A report is logged with the case identifier "IllegalContentReport/<id>". You receive written confirmation with the case identifier and an expected review window.
- The controller reviews the report. When the content is restricted or removed, a Statement of Reasons is generated under Article 17 DSA. Where the target user is a registered Selv-a user, the Statement of Reasons is made available to them in-app and contains: (a) a summary of the facts, (b) whether the decision was automated, (c) the legal reference or Terms / AUP clause applied, (d) the appeal path under Article 20 DSA and the Article 21 DSA ADR body (Conciliaweb AGCOM).
- Where the content is not restricted, the reporter is informed and given the same appeal path.
6. Redress
- Internal complaint-handling: privacy@selv-a.com. Written decision within 30 days for data-protection complaints.
- Out-of-court dispute settlement (Article 21 DSA): Conciliaweb AGCOM — conciliaweb.agcom.it.
- Complaint to a supervisory authority: Garante per la protezione dei dati personali, Piazza Venezia 11, 00187 Roma — www.garanteprivacy.it.
- Judicial remedy: Tribunale di Pavia for non-consumer disputes; consumer forum for residents of an EU member state under art. 66-bis Codice del Consumo.
